Privacy Policy

This Privacy Policy describes what personal information we collect through the Platform (defined below), why and how we use this information, how this information may be shared, and what choices and rights you have with respect to this information. Access to and use of our Platform is subject to this Privacy Policy.
The terms “we,” “us,” “our,” or “Locallista” refer to Getlocallista PT Unipessoal LDA and its corporate affiliates. By “you,” we are referring to visitors and users of any part of our Platform, including Customers and Businesses, as defined in our Terms of Use.
Our “Platform” in this document refers to the Locallista websites, applications, business portals, tools, emails, messages, chatbot or any other way you engage with Locallista and use the Locallista marketplace.
1. What is Personal Information
Personal information refers to any information which is related to, associated with, or could be reasonably linked to an identified or identifiable individual.
2. Collection of Personal Information
We collect personal information that: (i) you provide us, (ii) from third parties, and (iii) automatically when you use the Platform (for example cookies).
Information You Provide Us
We collect information that you provide us, including your account and profile information, content you submit or post to our Platform, your requests to access businesses’ information, your communications with us, and information you provide through surveys, contests or feedback.
Account or Profile Information. This may include name, phone number, email address, languages, time or time zone, gender, age, location (city/municipality), and profile information.
If you are a Business, this may also include:
- information related to your business (such as business name, description, phone number, physical and email address, areas of service, licenses and certifications and professional or educational experience),
- payment transaction information (such as credit card information, date, time and payment amount, billing address),
- online profiles (such as personal or business websites and social media profiles)
- identity and background screening information (such as copies of identification documents, proof of business ownership, tax numbers, or similar documentation as needed to verify your identity or conduct background screenings where relevant and proportionate to the category, risk profile or legal requirements applicable to the Business).
Content You Submit. This includes reviews, messages, comments, searches, photos, and other content you choose to provide.
Communications. When you communicate with us (via email, phone, the Platform, chatbots, or otherwise) we may record, transcribe, monitor, collect, and use details about you and your communications (including call time and call duration). We will provide you notice or obtain your consent in accordance with applicable law before recording or monitoring any of these calls. Recordings are generally retained for at least 30 days, and longer where necessary for integrity, dispute resolution, legal compliance, or enforcement of our Terms.
Surveys and Contests. If you participate in our surveys or contests, we may collect the information you provide.
Information from Others
We may receive and collect information that others make available to us, including information from other platforms or sites, publicly available information, and information from other users of the Platform.
For example, if you are a Business, Customers may provide us with feedback and public reviews about you or about your services, prices and processes. In addition, if you are a Business, consistent with applicable law and with your consent where required, we may collect personal information from background screenings and license verification providers. We may use your personal information, including your full name and date of birth, to obtain such reports.
Automatically Collected Information
Each time you access the Platform, information is sent to our server by your Internet browser or app and stored in our log files.
We collect information about your use of our Platform, including your search activity, the pages you view, the date and time of your visit.
We also collect information that your device provides to us in connection with your use of our Platform, such as your browser type, type of device, browser language, IP address, mobile carrier, unique device identifier, and requested and referring URLs. We may receive your device’s location if you enable this through your browser or mobile device. We may infer your general location from your IP address.
Cookies. We use cookies and similar technologies in connection with your use of the Platform for operation, analytics, and improvement. Cookies are small text files stored on your device when you visit a website. Some cookies are necessary for the Platform to function properly. Others help us understand how the Platform is used or support marketing and analytics activities. We use the following categories of cookies:
- Essential cookies – Required for the basic operation and security of the Platform. These cannot be disabled.
- Analytics cookies – Help us understand how visitors use the Platform so we can improve performance and user experience.
- Marketing cookies – May be used to deliver relevant information about the Platform and measure the effectiveness of campaigns.
Some cookies may be set by third-party service providers (for example, analytics providers). Where required by law, we obtain your consent before placing non-essential cookies. You may withdraw or adjust your cookie preferences at any time using our cookie settings tool or your browser settings. Disabling certain cookies may affect the functionality of parts of the Platform.
3. Use of Personal Information
We use the personal information we collect to (i) provide the Platform and support, (ii) develop, improve and personalize our Platform, (iii) communicate with you about our Platform (on and off our Platform), (iv) promote trust, safety and quality in the Locallista community, (v) provide, personalize, measure and improve advertising and marketing of Locallista services, (vi) legal compliance and dispute resolution, and (vi) if you are a Business, collect payment. The ways we do this include the following:
- to verify or authenticate information,
- to contact you, in accordance with our Terms of Service, to send you important information and to contact you in order to collect reviews and feedback about the Platform and about Businesses you have used that you found on our Platform (or Customers, if you are a Business);
- to provide and improve our Platform and its features and functionality, including to learn which features are missing or need to be improved;
- to evaluate use of our Platform for our business purposes and to provide and improve our products and services, including learning which categories need to be added or enriched with more content and Businesses;
- to personalize your experience, such as tailoring the content and information made available to you and our support services;
- to display relevant or targeted advertising (on our Platform and third-party sites) for us and other businesses and to evaluate the success of such advertising;
- to provide feedback to Businesses on our Platform;
- to communicate with you as described in our agreements with you (for example, our Terms of Service) or this Privacy Policy;
- to maintain a quality experience for our business purposes or legal reasons, including to filter for spam and communications that violate our agreements;
- to enforce compliance with our agreements with you and applicable law;
- to comply with our legal obligations;
- to perform research and analysis for our business purposes and to conduct journalist research;
- to award badges and similar designations and if you decide to participate, to administer surveys or promotions.
Legal Bases for Processing Personal Information
We process personal information based on one or more of the following legal grounds:
- performance of a contract (to operate the Platform and provide services),
- legitimate interests (such as operating and improving the Platform, ranking Businesses, quality control, fraud prevention, and ensuring Platform integrtiy),
- consent, where required (for example certain marketing communications),
- compliance with legal obligations.
4. Sharing Your Personal Information
We do not sell personal information. We may share your personal information in the following ways:
If you are a Business. We only share your information with third-parties as intended to be used by the Platform. This means that the details you provide and agree to publish for Users of the Platform will be visible for them.
If you are a Customer. We only share your first name and municipality of residence when we publish your review for a Business on the Platform, unless you request to provide an anonymous review in which case your review is published without any personal information.
For all Users:
Third-Party Vendors or Partners. We may share personal information with third-party vendors or partners who process data on our behalf (for example hosting, analytics, communications, verification, background screening, and payment systems), subject to contractual safeguards. The Platform may include links to third-party websites or services that Locallista does not control. When you interact with these third parties, you are providing your personal information to them. Your use of these services is subject to the privacy policies of those providers, including for example Stripe’s Privacy Policy.
Legal Obligations, Prevent Harm, and Protect Our Rights. We may disclose your personal information, as required or permitted by applicable law, if we believe that such disclosure is reasonably necessary to (a) comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us, a service provider, or a partner (which may include disclosure to law enforcement, courts, or governmental authorities); (b) prevent, investigate, or identify possible wrongdoing in connection with the Platform; (c) protect our rights, reputation, property, or that of our visitors, Users, corporate affiliates, or the public; (d) enforce compliance with our agreements with you or (e) as part of Locallista’s merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your personal information, in connection with such transaction or in contemplation of such transaction, such as due diligence.
With your Consent. We may share your personal information where you provide consent or direct us to do so.
International Transfers. Your personal information may be transferred to and processed in countries outside your place of residence, subject to appropriate safeguards and applicable law.
5. Communications
Certain communications are necessary to operate the Platform and deliver its core features, including facilitating contact between Users and Businesses, managing requests, collecting reviews and feedback, addressing quality, safety or trust concerns, and providing service-related notices. These communications may be delivered via email, phone calls, text messages, or the Platform and are an integral part of using the Platform. We communicate with you about your account, privacy, use of the Platform, including news relating to the Platform, its features and relevant industry developments. We also ask for your feedback about your experience in connection with our Platform and Businesses/Customers or about your experiences as an expatriate.
Separately, where permitted by applicable law, we may send you marketing or promotional communications about Locallista, the Platform, co-branded products and services, professionals, merchants, and other businesses made available on the Platform (for example, tips, offers, and similar services). You may opt-out of marketing communications at any time.
6. Your Choices and Rights
Access to and Portability of Personal Information. You can ask us to confirm if we are processing your personal information, provide you with details about our processing, and access a copy of the personal information we hold about you. Where applicable, you also have the right to receive copies of personal information you provided to us in a structured, commonly used, and machine-readable format and request us to transmit this personal information to another service provider (where technically feasible).
Correct Your Personal Information. You can update your information or correct inaccurate data by contacting us, or if you are a Business, you may manage your business details on the dedicated pages on our Platform.
Delete Your Personal Information. You can request permanent deletion of your personal information and we will delete your personal information unless we are required or permitted to keep it for legal, regulatory, security, or legitimate business reasons, as further described in the Retention section below.
Withdraw Consent. If we are processing your personal information based on your consent you can withdraw your consent at any time. Please note this will not affect the lawfulness of any processing activities based on such consent before your withdrawal.
Request Restriction of Processing. You may ask us to limit how we use your personal information in certain situations, such as: when you believe the information is inaccurate, the processing is unlawful and you prefer restriction instead of deletion, we no longer need the information but you need it for legal reasons, or you have objected to our use of the information and we are reviewing that request.
Object to Processing. You may object to our use of your personal information in certain cases, including where we use it for direct marketing or based on our legitimate interests. If you object, we will stop using your personal information for those purposes unless we have a strong legal reason to continue or are required to keep using it for legal reasons.
Complaints. If you would like to raise a concern about our use of your information, please contact us first. We respond to all requests we receive from individuals wishing to exercise their data protection or privacy rights in accordance with applicable privacy and data protection laws. Please note, we may also ask you to verify your identity in order to help us respond to your request securely and efficiently. If you are located in the European Economic Area, you also have the right to lodge a complaint with your local supervisory authority.
Communications Preferences. You may request to stop receiving communications with us by either clicking the unsubscribe links or instructions in each of our communications with you, or by contacting us.
Cookie Preferences. You can manage cookies set via the Platform by using our cookie consent tool that’s available on the Platform.
Exercise of Rights. Unless described otherwise above, you may exercise any of these rights by contacting us as provided below in the Contact Us section.
7. Data Security and Retention
Data Security. While no system can guarantee absolute security, we use reasonable technical and organizational measures to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the personal information.
Retention. We will keep your personal information only for as long as necessary to fulfill the purposes for which we are processing your personal information unless the law permits or requires us to retain your personal information for a longer period. For example, we may need to keep your personal information to provide services on our Platform, for legitimate business purposes such as preventing fraud or misuse, to comply with legal, tax or regulatory obligations, to enforce our agreement, to resolve disputes or to defend future legal claims.
We may retain aggregated and/or de-identified information after the personal information has been deleted.
In addition, personal information you have shared with others, such as reviews or postings, may remain visible.
Please note that copies of personal information (including those deleted) may continue to reside in our backup systems for a limited period of time as part of our business records.
8. Children
The Platform is not intended for individuals under 18.
We do not knowingly collect personal information from children under 18. In the event that we learn that we have collected personal information from a child under age 18, we will take reasonable steps to delete that information. If you become aware or believe that a child has provided us with personal information, please contact us as provided in the Contact Us section.
9. Updates to this Privacy Policy
We may revise this Privacy Policy from time to time. Updated versions will be posted on this page with the “Last updated” date at the top. The most current version of our Privacy Policy will govern our use of information about you. If we make material changes to our Privacy Policy, we will notify you by email or by posting a notice on our Platform or by other means, to offer you an opportunity to review the changes before they become effective. By continuing to access or use our Platform after those changes become effective, you are subject to the revised Privacy Policy.
