Locallista Terms of Service
Last updated: 18 February 2026
For new Users (Customers or Businesses), this version is effective immediately.
For Businesses already listed on the Platform as of 18 February 2026, this version will take effect on 31 March 2026.
1. Why this document is important
This document explains how the Locallista Platform works, what we are committed to doing, what we expect from Customers and Businesses, and how we protect the trust and transparency that make the Platform useful (terms defined below).
These terms and conditions, together with any policies and documents referenced in them, including the Privacy Policy (the “Terms”) form a legal agreement between:
- anyone accessing or using the Platform (a "User", "you") and
- GetLocallista PT, Unipessoal LDA ("Locallista", "we", "us").
By accessing or using the Locallista Platform, you agree to these Terms.
If you’d like more information, you might find it helpful to read our FAQs but these FAQs don’t form part of our Terms with you.
2. Definitions
Platform. The Locallista websites, applications, business portals, tools, and related services.
User. Anyone accessing or using the Platform.
Customer. A User looking for services or information about service providers.
Business. Any service provider applying to list or listed on Locallista, including employees or representatives acting on its behalf.
3. What Locallista is and what we are committed to
Locallista is a discovery, trust, and reputation platform. We help Customers find relevant service providers, and we help quality Businesses build reputation through transparent feedback and accountability.
We are a Portuguese company, registered with the Commercial Registry Office of Lisbon under number 517461005 and a registered office at Avenida António Augusto de Aguiar, 148, 4º C, Lisbon 1050-021, NIF 517461005.
Locallista is built on three principles:
- Customer interest comes first
- Transparency for Customers and Businesses
- Trust as the foundation of the entire Platform
We are committed to maintaining a reliable and trustworthy directory. That includes:
- Running an onboarding and screening process for Businesses (with the scope varying by category) as described in our published onboarding materials and policies.
- Monitoring quality signals over time (such as review outcomes, responsiveness, and community feedback).
- Moderating the Platform and acting where Customer trust or safety may be at risk.
- Publishing key processes and criteria so the community understands how the Platform works.
Limits of verification. Onboarding and verification steps are limited in scope, are not exhaustive, and should not be interpreted as a guarantee of competence, compliance, or suitability.
No payments through Locallista. Locallista is not a payment processor, escrow service, or financial intermediary. All payments are handled directly between Customers and Businesses.
Third party information. Locallista relies in part on information provided by Users, Businesses, and third parties and does not independently verify all information unless explicitly stated.
Users over 18. The Platform is intended for Users aged 18 and over. By using the Platform, Users confirm that they are at least 18 years old.
4. General terms for all Users
4.1 Trust-based use of the Platform and red lines
Locallista relies on honest behavior. We trust Customers to provide honest feedback and we trust Businesses to report truthfully and behave professionally.
Because the Platform depends on trust to operate and to keep improving the directory, violations of trust are a red line. In addition, any misuse of Platform data, including scraping, extraction, resale, or use for competing services, is considered a material breach of these Terms.
Trust violations and data misuse may result in suspension, permanent removal from the Platform, and where appropriate, taking legal action available under applicable law to stop the behavior and seek damages for harm caused.
4.2 No supervision or control of Business services
Locallista does not supervise, manage, direct, or control services provided by Businesses.
All services are delivered independently by Businesses, and all agreements and terms are determined solely between the Customer and the Business.
Locallista is not a party to any service agreement between Customers and Businesses and does not control pricing, execution, or outcomes.
4.3 Proper use and prohibited misuse
All Users must:
- Use the Platform only for its intended purpose and in accordance with these Terms.
- Act honestly, in good faith and without discrimination of protected characteristics such as race, religion, gender and age.
- Respect other Users and the community.
The following are prohibited for all Users:
- Accessing the Platform or using any data from the Platform for outreach, resale, solicitation, marketing lists, or competing services or for any purpose other than providing or purchasing services.
- Scraping, copying, extracting, or harvesting Platform data, manually or automatically (including bots, browser automation, or AI agents).
- Creating derivative databases, datasets, or directories from Platform content.
- Attempting to bypass or misuse Platform processes or controls.
Enforcement. Locallista may suspend or permanently remove access and pursue legal remedies where appropriate.
4.4 Intellectual property
The Platform. The Platform, including its structure, databases, content, trademarks, copyrights and software (“Locallista IP”), is owned by Locallista or its licensors and is protected by intellectual property laws. Users receive a limited, non-exclusive right to use Locallista IP solely for its intended purpose. This does not mean you can use Locallista trademarks, you may use Locallista trademarks only if Locallista approves in writing in advance.
User Content. When you provide, share, or communicate feedback, text, photos, audio, video, information and other content to Locallista (“Content”), you confirm that you have the right to use and share such Content. You will bear full responsibility for any claims from a third party regarding content you upload.
You also grant Locallista permission to use, modify, translate and display the Content in any way and form, and in any media and platform. This right continues even if a User is no longer using the Platform.
Where Locallista pays for the creation of Content, Locallista will own that Content.
Locallista does not guarantee the accuracy or quality of generated Content, but Locallista may remove or restrict access to Content that it reasonably believes is misleading, unlawful, discriminatory, infringes third-party rights, or undermines Platform trust.
4.5 Reporting violations
If you believe that a User’s behavior poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Locallista.
If you believe that a User or Content violates these Terms or our standards, you may report your concerns to Locallista. Locallista may review such reports and take action where appropriate. Except where required by law, Locallista is not obligated to take action in response to any report.
4.6 No partnership or agency
Nothing in these Terms creates a partnership, joint venture, agency, employment, or representation relationship between Locallista and any User.
Businesses operate independently and on their own behalf and are not employed by Locallista.
4.7 Privacy, communications, and data retention
Our Privacy Policy explains how we collect and use personal data, including contact details, reviews, verification records, and communications metadata. The Privacy Policy is incorporated by reference into these Terms.
Service messages. We may send you operational messages (for example account, security, verification, reviews, lead status, fees, policy updates).
Marketing. Where required by law, we will ask for your consent for marketing communications. Where marketing is allowed based on another lawful basis, you will always have a simple opt-out.
Data retention. We keep personal data only as long as necessary for Platform operation, fraud prevention, dispute handling, legal compliance, and enforcing these Terms. Retention periods and deletion processes are described in the Privacy Policy.
4.8 Changes to the Platform, availability and security
Changes to the Platform. Locallista may change or remove features or functionalities of the Platform from time to time, including the types of services or listings supported. We do this to improve the Platform, prevent misuse, or respond to legal or regulatory requirements.
If a change materially affects how Businesses use the Platform, we will provide reasonable advance notice, unless the change is required urgently for legal, security, or abuse-prevention reasons.
Platform availability and security. To the extent permitted by law, the Platform is provided “as is” and “as available”. Locallista does not guarantee uninterrupted or error-free operation of the Platform, nor that the Platform is completely secure and that unauthorized access will never occur. Temporary interruptions may occur due to maintenance, technical issues, third-party services, or events outside Locallista’s reasonable control.
4.9 Changes to these Terms
These Terms may be updated periodically to reflect changes to our operations or legal requirements. Updated versions will be posted on this page with the “Last updated” date at the top of these Terms.
Material changes. For material changes (like to your main rights/obligations, review rules, data handling, or commercial terms), we will notify you at least 30 days in advance:
- For Customers - via website banner notice.
- For Businesses – via email to the Business email contact details on file. Businesses are responsible for keeping their contact details up to date.
You are responsible for checking your notifications/dashboard and keeping Business contact details updated.
Your rights if you disagree. Businesses can de-list without penalty before changes take effect. Customers can stop using Locallista and delete their account.
Continued listing or use of the Platform after the effective date means acceptance of the updated terms.
5. Additional terms for Customers
5.1 How the Platform works for Customers
Customers use Locallista to:
- Discover service providers relevant to a service they need.
- Read reviews and compare providers.
- Request business contact details to get in touch.
To protect the integrity of the Platform and encourage fair engagement, Locallista may display only partial Business identity before a contact request (for example first name and profile photo), without contact details, website link, phone number, and full address.
Only after a Customer requests to get in touch do we share the Business’s contact details. After contact details are shared, the Customer and the Business communicate directly.
By using the Platform, Customers agree:
- Not to request contact details unless they genuinely intend to evaluate or obtain the service.
- That Locallista may share their contact information with the Business when they request the Business contact details or ask the Business to contact them.
- That Locallista may contact them after requesting Business contact details for quality control and review collection, whether the Businesses is ultimately hired or not. Locallista may contact Customers by phone, SMS, instant messaging apps, email, or any other communication channel.
- To provide truthful and honest feedback (review) about their experience, and Users understand that if they fail to provide a review, their account and their access to the Platform may be limited.
- To have their review published (Customers may request to stay anonymous).
- That Locallista may process and store their personal data in accordance with applicable law and the Locallista Privacy Policy.
5.2 What Locallista is responsible for and what it is not
Locallista is committed to operating a trustworthy directory. We do this by onboarding, screening, monitoring, and moderating the Platform based on our published policies. The depth of checks varies by category of service. Some categories may include strict license validation, and others may include lighter checks.
Customers understand that:
- Locallista does not provide the services listed on the Platform and does not control how a service is delivered.
- Locallista does not guarantee outcomes, prices, or availability.
- Locallista does not guarantee the accuracy of the details that are provided by the Businesses and listed on the Business profile page of the Platform beyond the checks described in the published Business onboarding policies.
- Customers are solely responsible for choosing which Business to hire and for checking suitability, scope, insurance, credentials, and licensing if relevant.
Locallista may, in some cases, facilitate communication or encourage resolution, but Locallista is not responsible for resolving disputes between Customers and Businesses.
5.3 Reviews and honest feedback
Reviews are a foundational part of Locallista. Customers commit to providing honest, fair, and unbiased feedback.
Customers must not:
- Accept benefits or incentives in exchange for reviews.
- Provide false, misleading or manipulated reviews.
- Use reviews to extort or pressure Businesses.
- Include in their review any discriminatory, offensive, defamatory, or other language that violates applicable law.
Customers may request that their identity not be disclosed publicly with a review. Locallista may retain internal records related to reviews for integrity, fraud prevention, and dispute handling while respecting Customer confidentiality in accordance with applicable law.
5.4 Feedback about Customers
Customers acknowledge that Businesses may provide feedback about their interactions with Customers, and Locallista may make these feedbacks or engagement history visible to Businesses in order to help them decide whether to engage with that Customer.
5.5 Ambassador and community programs
Locallista may offer ambassador or community programs to certain Customers from time to time (“Ambassador Program”). Participation in the Ambassador Programs is voluntary and is intended to support community growth, feedback, and awareness of the Platform.
Transparency and Trust. Ambassadors must act honestly and in good faith. Participation in the Ambassador Program does not permit incentivized, misleading, or non-genuine reviews, and does not override Locallista’s review and trust principles.
Benefits. Locallista may, from time to time, offer non-cash benefits, recognition, or other perks to those participating in the Ambassador Program. Participation does not guarantee any benefit and does not constitute compensation for services.
No agency. Participation in the Ambassador Program does not create any employment, agency, partnership, or representative relationship with Locallista. Ambassadors participate solely as independent users of the Platform.
Termination. Locallista may suspend or end a Customer’s participation in the Ambassador Program at any time, including if participation is inconsistent with Platform rules or trust principles. Customers may stop participating at any time.
5.6 Customer compliance and enforcement
Customers are expected to comply with these Terms. Customers who violate these Terms, misuse the Platform, or act in a manner that undermines trust or integrity may have their access suspended or blocked, and where appropriate legal action may be sought.
5.7 Limitation of liability (Customers)
As described above, Locallista is committed to:
- Operating a reliable directory for Customers through onboarding, monitoring, and moderation processes in accordance with our published policies.
- Taking reasonable action when we believe Customer trust, safety or Platform integrity is at risk.
- Keeping our key policies transparent and up to date.
These commitments describe how Locallista operates the Platform. They do not constitute a guarantee of service outcomes, provider performance, or customer satisfaction and they do not create any additional duty or liability beyond what is expressly stated in these Terms.
To the extent permitted by applicable law, Locallista is not liable for:
- The quality, performance or outcome of any service delivered by a Business.
- Pricing disputes or payment issues between Customers and Businesses.
- Damages or losses arising from services performed by Businesses.
- Inaccuracies in Business-provided information beyond the checks described in our published onboarding policies.
Customers use the Platform at their own risk and acknowledge that Locallista’s role is limited to operating the directory and trust framework described in these Terms.
Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.
6. Additional terms for Businesses
6.1 How the Platform works for Businesses
Customers use Locallista to discover businesses and request contact details. Businesses are listed according to categories.
Before a Customer requests contact details, the Platform may display only partial Business identity without direct contact methods. After the Customer requests contact details, Locallista shares the Business’s contact details with the Customer.
From that point:
- The Customer and Business communicate directly (phone, email, WhatsApp, in person, or other channels they choose).
- The Business and Customer negotiate directly (scope, timing, price, and terms).
- The Customer hires the Business directly.
- If applicable, the Customer pays the Business directly.
- If the Business is hired and paid for the job, the Business pays a service fee to Locallista.
- Locallista then collects the Customer review about the quality of service for the Business and publishes those reviews on the Platform.
Locallista is not involved in the negotiation, contracting, service delivery, or payment collection.
6.2 Joining Locallista, onboarding requirements, and permissions
Businesses apply voluntarily to join Locallista. Acceptance is not guaranteed and depends on our onboarding requirements as described on the Platform.
The detailed onboarding steps may change over time and are described in separate onboarding documentation. By applying to join or joining, the Business agrees to comply with onboarding requirements and specifically agrees that Locallista may:
- Contact the client references (including past clients) provided by the Business for quality monitoring (collecting feedback about services performed by the Business for those clients).
- Verify licenses, certifications, and credentials with relevant authorities and registries where applicable.
- Use third-party providers to perform verification steps, including identity checks, credential checks, license validity checks or general background checks.
- Store records and documents provided by the Business for future verification, integrity, and Platform operations.
- Perform background checks as permitted by law about the Business or its employees and partners.
- Invite the business to an online interview with our businesses quality team.
The Business must provide truthful information. Providing false information is a serious trust violation.
6.3 Participation as a privilege
Being listed on Locallista is a privilege, not a right. By applying to join or joining, Businesses make a conscious decision to participate in a trust-based community and commit to comply with all of the following:
- These Terms.
- Published Platform policies (including review and onboarding policies).
Continued listing is conditional on compliance with these Terms, Platform standards, and quality expectations.
Locallista aims to operate transparently, but the Business acknowledges that final decisions may sometimes require judgment calls, including decisions based on attitude, willingness to cooperate, and overall fit with the community.
6.4 Business categories and commercial terms
Businesses may appear on the Platform in more than one category. During the onboarding process, Businesses must list all services they offer in each category.
Each category has specific commercial terms such as fee structures, calculation logics, and triggering rules (“Category Commercial Terms”), which are agreed to during onboarding and incorporated into these Terms by reference. Locallista will make available, on request or via the Business portal, a dated copy of the Category Commercial Terms that applied when the Business joined (including later accepted updates).
Category-specific calculation rules may also be published in a calculator/simulator page that shows how fees are calculated for each category and price point.
6.5 Customer vetting and risk
Locallista does not vet, verify, or validate Customers. Businesses are solely responsible for assessing whether to engage with a Customer, including evaluating personal safety, payment risk, access to premises, and suitability of the request.
While Locallista may suspend or block customers following complaints or misuse, Businesses acknowledge and agree that they must not rely on Locallista to do so, and Locallista may choose not to suspend or block a Customer. Additionally, Locallista cannot guarantee that a blocked Customer will not rejoin the Platform using different or inaccurate details.
6.6 Locallista Fees
6.6.1 Entry fee
In some categories of service, Businesses may be requested to pay a one-time entry fee during onboarding. Entry fees are per location so if a Business is listing in more than one location, multiple entry fees may be required.
The entry fee supports:
- Onboarding, screening, and vetting costs.
- Ongoing community maintenance and moderation.
- Commitment to the Platform's standards and community obligations.
- Locallista-produced marketing materials and assets for the Businesses (if provided).
- The effort required to maintain a reliable and trustworthy directory.
What Locallista does not charge:
- No monthly listing fee.
- No recurring "membership" fee to stay listed.
- No pay-per-lead fee.
- No payment for preferred placement.
- No advertising payments for higher ranking or "featured" positioning.
Lifetime eligibility. The entry fee provides lifetime eligibility to remain listed (in the applicable location) only as long as the Business continues to comply with these Terms, the Platform rules, quality standards, commercial terms, and community expectations. Listing is always conditional on ongoing compliance and performance.
6.6.2 Service Fees
Locallista invests significant resources to build reputation and trust with Customers and to maintain a reliable directory of service providers, and our business model relies on Businesses paying us fair service fees when they win new paying Customers as a results of this investment and Platform reputation.
Service fees apply only when the Business receives payment for a job that is “fee-triggering”. If the Business does not receive any payment for the job, no service fee is due.
A job is considered “fee-triggering” when the engagement with the Customer relating to a specific job or service originated from the Customer finding the Business and obtaining the Business’s contact details from the Platform.
Customers get in touch directly with Businesses once they receive the contact details from the Platform. Locallista relies on the Business or Customer reporting of completed jobs to charge the Business a service fee for the completed job. Businesses and Customers are responsible for accurately reporting completed jobs.
When Businesses win a new Customer through the Platform, the Business typically pays a service fee only for the first paid engagement with the Customer and may continue to work with that Customer in the future without paying additional service fees if the Business wins the trust of that Customer.
To read the full terms that apply to service fees, refer to Appendix A - Service Fee for Businesses which forms an integral part of these Terms of Service.
6.6.3 Disputes and non-payment
Locallista is built on trust and as such, Locallista’s primary enforcement for unpaid service fess is Platform access (suspension or de-listing), not court action.
If the Business does not agree with a service fee it believes is due, the Business may choose to de-list instead of paying.
Entry fees are not refunded in service fee disputes or de-listing caused by service fee disagreements.
6.6.4 Refunds and cancellations
General rule - no refund. Locallista fees are business-to-business fees for customer acquisition and platform services. They are not consumer purchases, and statutory consumer refund, withdrawal, or cooling-off rights do not apply.
Once a fee is triggered under these Terms, it remains due regardless of:
- Any refund, cancellation, or dispute between the Business and the Customer or third party payer
- Any partial or full repayment made by the Business to the Customer
- The Customer's exercise of consumer rights vis-à-vis the Business
Any refund or compensation granted by a Business to a Customer is a matter solely between the Business and the Customer and does not affect Locallista’s entitlement to fees already triggered under these Terms.
Grace period refunds. Businesses may request a refund within seven days of payment if an error is found in the settlement process.
Entry fee refunds — Refund for non-acceptance. If onboarding of a Businesses is not completed successfully and the Business is not listed on the Platform, any entry fee paid will be refunded in full.
Refund for change of terms. If Locallista makes a material commercial change to these Terms within 3 months after the Business joins, and the Business has not received any paying Customers through Locallista during this period, then:
- The Business may choose to no longer be listed on the Platform due to the change, and
- Any paid entry fee will be refunded in full.
Anniversary refund. At the 12-month anniversary of a Business on the Platform (12 months after being listed) the Business may request a refund of the entry fee only if all are true:
- The request for a refund is sent to Locallista within 30 days following the anniversary date.
- The Business is also requesting to de-list from the Platform.
- The Business has been listed during the entire 12 month-period and has complied with these Terms and all Platform rules and requirements during such time.
- The Business received no leads through the Platform (or, where Locallista guaranteed a minimum number of leads during the first 12 months and failed to meet it).
- The Business has fulfilled all its obligations to Locallista and has no outstanding unpaid fees.
If the Business decides to de-list, it is not entitled to keep any membership rights or benefits and must stop using all Locallista-related assets as of the de-listing.
Except as provided above, entry fees will not be refunded in any other case.
No refund in the event of breach. In any event, no refund will be provided if the Business is in breach of its obligations under this Agreement.
6.7 Reviews, transparency, and integrity
Reviews are foundational to Locallista and are not a marketing gimmick. They are the mechanism that protects Customers and rewards the best Businesses.
Locallista is committed to collecting reviews and publishing them transparently, subject only to the defined exceptions in the published Review Policy.
Businesses understand and agree that:
- Locallista contacts Customers to collect reviews after contact with the Business was initiated through the Platform.
- Reviews may be bad for the Business and may impact its reputation and performance both on and off the Platform.
- Reviews will be published as provided by Customers and may be anonymous if requested by the Customer.
- Locallista does not allow manipulation of reviews and will not change any review without the Customer's consent.
- Locallista takes reasonable measures to prevent publishing defamatory reviews, but reviews that are a subjective perspective of the Customer (even if bad for the Businesses) will be considered valid and lawful and will be published.
- Any communication about a review is to be done only with Locallista and never directly with the Customer.
Strict prohibitions. Businesses understand that compromising the reliability of the reviews may cause serious damage to Locallista and its reputation, and therefore agree to not:
- Incentivize in any form or pressure Customers in making or not making a review.
- Discuss with Customers what they should say or ask Customers to provide dishonest details.
- Contact a Customer after a review is published to discuss the details of the review.
- Conduct in any behavior that otherwise undermines Customer trust or the integrity of the directory.
These behaviors are considered severe trust violations and may trigger immediate suspension, removal or legal action.
Waiver of Claims. The Business waives any claim of harm as a result of negative Customer reviews and agrees it will not have the right to take any legal action against a Customer (except as described below) or otherwise apply any pressure on a Customer.
The Business may notify Locallista in writing that a Customer acted maliciously to harm the Business and Locallista will conduct an investigation within 60 days of the notice. If Locallista agrees in writing that the Customer did act maliciously to harm the Business, then the Business can take legal action that Customer. The Business undertakes to compensate Locallista for any damage (including legal expenses) that may be caused to Locallista as a result of the Business’s claim against a Customer.
Pricing fairness. Businesses are not allowed to charge Locallista Customers higher prices than customers acquired through other channels for comparable services. Any discounts, promotions, or preferred pricing offered elsewhere must be honored equally or better for Locallista Customers.
6.8 Business additional commitments
Locallista exists to protect Customers and maintain a directory that Customers can trust. Businesses benefit from that trust through reputation and lead flow. In return, Businesses commit to:
Quality and Customer-first standards:
- Provide high-quality service and reasonable effort to leave Customers satisfied.
- Treat Customers respectfully and professionally.
- Understand that poor service harms the entire community and other Businesses.
Professional competence and credentials:
- Only offer services the Business is competent and if applicable, licensed, to deliver.
- Provide all services in accordance with the laws and regulations that apply to you.
- Maintain required licenses, certifications, and insurance where applicable.
- Provide truthful credential information and cooperate with verification.
Accurate profile and transparency:
- Keep profile information accurate and updated.
- Notify Locallista where there is a change in ownership of the Business.
- Update availability when unable to accept work.
- Avoid misleading claims, misrepresenting credentials, licenses, insurance, or experience, or missing critical details.
Responsiveness:
- Respond to Locallista leads promptly.
- Return missed calls and messages.
- Recognize that Customers calling shortly after a contact request are likely Locallista-originated and should be treated accordingly.
Community support:
- Support the growth of the community and, when reasonable, help promote Locallista to potential users and other quality businesses.
- The intent is to strengthen the ecosystem that generates trust and demand for everyone.
Reporting obligations:
- Report lead status, job completion and payment receipt truthfully and on time.
- Report amounts received where relevant to fee calculation.
- Notify Locallista when the Business becomes aware of risks, major issues, or violations that could harm Customers or the Platform.
No interference with core Platform principles: Businesses must not interfere with the core principles of the Locallista model, including:
- Initiating contact with a Customer without the Customer first contacting the Business. It is clarified that Locallista provides the Business with partial details about a Customer requesting the Business's contact details, for identification purposes only.
- Asking Customers not to provide a review.
- Asking Customers to provide dishonest information.
- Trying to move the interaction outside the Platform's intended flow in order to avoid accountability, review collection, or fees.
Any similar behavior that undermines transparency and trust.
Locallista profits only when a lead referred to the Businesses can be tracked. Locallista can only track a lead if Customer requests the Business’s contact details through the Platform. This is why Businesses are not allowed to publish contact information on their Platform profile or other details that facilitate finding the Business easily out of the Platform.
6.9 Ranking, equal treatment, and no paid placement
Locallista is committed to fairness and Customer-first outcomes.
- Businesses in the same category are treated equally.
- Locallista does not sell preferred placement.
- Locallista does not accept advertising payments in exchange for ranking advantages.
- Businesses are presented based on relevance to the Customer's need and then sorted only by their total quality score.
This approach exists to maximize the chance that Customers find the best fit and have a great experience, which is also what creates long-term value for good businesses.
Ranking and visibility may change over time based on relevance, customer feedback, performance signals, and Platform changes. Locallista does not guarantee any particular ranking, visibility, or position on the Platform.
6.10 Availability, performance monitoring and consequences
Locallista operates a curated directory built on trust, responsiveness and consistent Customer experience.
Businesses listed on the Platform are expected to:
- Be reasonably available to accept new service engagements in their listed categories.
- Respond to leads in a timely and professional manner.
- Convert quality leads into confirmed service engagements where commercially appropriate.
Locallista monitors performance because a directory is only useful if customers regularly succeed in finding what they need and receive responsive and professional service.
Locallista may monitor, by category and over time:
- Responsiveness
- Conversion of quality leads into service engagements
- Customer outcomes and satisfaction
- Patterns indicating repeated unavailability, failure to serve or Customer disappointment
If a Business repeatedly receives quality leads but fails to convert them, or repeatedly creates a poor Customer experience, Locallista may:
- Reduce that Business's visibility
- Suspend the Business
- Remove the Business
The rationale is simple: showing to Customers Businesses that repeatedly fail to serve them is a bad customer experience and undermines Platform trust and value for the entire community of Customers and Businesses.
To maintain marketplace reliability, Businesses who are temporarily unavailable must update their availability status or request temporary suspension through the Business portal. Businesses may request suspension for up to 8 weeks per calendar year. Longer periods may be approved at Locallista’s discretion for justified reasons.
In all cases the rules for limiting a Business visibility will be transparent and shared with Businesses to allow Businesses to address the situation, remediate and improve their performance on the Platform.
6.11 Suspension and removal
Locallista may suspend or remove a Business at any time, and immediately if needed, for example due to:
- Score falling below the published threshold for the Platform or category (threshold may be updated over time).
- Severe complaints, including physical or verbal harassment.
- Trust violations.
- Non-payment of due fees within Platform timelines.
- Repeated inconsistencies between Customer reports and Business reporting.
- Unresponsiveness.
- Missing required licenses/insurance where applicable.
- Misleading or inaccurate profile information.
- Poor availability or repeated inability to serve Customers.
- Failure to meet the commitment to support the growth of the Platform or acting in a way that undermines its reputation.
- Misfit with Platform standards or unwillingness to cooperate.
- Potential criminal concerns or safety risks (Locallista may act conservatively to protect Customers).
- Threats of legal action or when legal action is taken against Locallista or a Customer.
Notification. Locallista may notify the Business and provide an explanation as Locallista sees fit. Locallista may limit or withhold details where disclosure is not in the best interest of Customers, the complainant, or the Platform.
Customer communication. Locallista may notify Customers that a Business is no longer listed. This protects Customers who engaged under the understanding that the Business was listed and subject to Locallista monitoring and standards.
6.12 De-listing
Businesses may de-list at any time by sending a written request to Locallista. Locallista undertakes to remove the Business’s information from the Platform within 5 business days of receiving such request.
Any Business that is de-listed, whether by Business choice or Locallista’s decision, must:
- Stop using Locallista branding, badges, and "member" claims.
- Stop using Locallista-produced marketing materials and assets.
- Stop representing itself as a Locallista member business, as listed, endorsed, or monitored by Locallista.
In addition, the Business gives up all rights associated with its membership, including any:
- Profit-sharing rights and any membership share or participation rights.
- Benefits tied to being an active listed business.
6.13 Remaining obligations
In any event, where the Business is no longer on the Platform, the Business is still obligated to pay Locallista any service fees due for jobs that were agreed to with a Locallista Lead (as described in Section 6.6.2 above).
In addition, all sections relating to liability, fees, misuse, data abuse, disputes, and obligations that by their nature should survive termination shall survive de-listing or account closure.
6.14 Transparency and discretion
Transparency is a core principle. We publish key processes, criteria, and policies, and we aim to be clear about how things work.
At the same time, we must protect Customers and the community. Locallista reserves the right to make judgment calls and take action where we believe it is necessary, even if:
- The specific scenario is not listed in these Terms, and/or
- We cannot share full details (for example to protect a Customer, a confidential complaint, or the integrity of the Platform).
Customer interest always takes priority.
6.15 Partner Programs
Locallista may offer certain Businesses the opportunity to participate in partner, referral, or community programs (each a “Program”). Participation in any Program is optional and subject to ongoing compliance with these Terms and any additional program-specific terms made available by Locallista (such as the Partner Profit Participation Program Legal Terms), as updated from time to time.
Partner programs are intended to support collaboration and Platform growth. Participation does not guarantee leads, revenue, visibility, or any commercial outcome, and does not create exclusivity, agency, employment, or partnership.
Locallista may change, suspend, or discontinue any partner program at any time. Continued participation following changes constitutes acceptance of the updated terms.
6.16 Business Materials
When Locallista produces materials for a Business (for example marketing materials, profile assets, templates, visuals, or copy), those materials are provided to support the Business’s presence on the Platform and to help the Business promote its services through social media, newsletters, and more.
However, such materials may not be exclusive and may be reused, adapted, or used as a basis for materials created for other Businesses or for the Platform generally.
Customer Reviews. Customer reviews are not Business materials, and the Business has no right to present or use them in any way, including on other websites, social networks, or other advertising, unless Locallista approves this in writing and in advance, with respect to each specific use. This is at Locallista sole discretion and applies regardless of whether service fees were paid by the Business or not.
6.17 Limitation of liability (Businesses)
Locallista aims to elevate Businesses’ long-term success through increased exposure, credibility, and engagement. We continuously invest time, effort, and marketing resources to help Businesses generate meaningful opportunities even beyond the Platform. Businesses acknowledge that being a Locallista member business creates value beyond direct leads - a single lead may result in multiple engagements or opportunities and listing on the Platform enhances reputation, visibility, and trust within their market.
At the same time, Locallista does not guarantee any business outcomes or that a Business will receive any minimum number of leads, conversions, bookings, or revenue.
In addition, Locallista is not responsible for any damages that may be caused to the Business due to Locallista’s decision to remove the Business from the Platform (for any reason), changes in the Business’s ranking (for any reason), or relating to any Customer review.
To the extent permitted by applicable law, Locallista is not liable to a Business for:
- Loss of profits, revenue, goodwill, or business opportunities
- Indirect or consequential losses
- The number, quality, or conversion of leads
- Customer decisions, behavior, or payment defaults
- Changes in ranking, visibility, or placement on the Platform
- Losses arising from suspension, de-listing, or reduced visibility carried out in accordance with these Terms
The Business acknowledges that its participation in the Platform is at its own commercial risk and that Locallista’s role is limited to operating the Platform in accordance with these Terms and its published policies.
In any event, Locallista’s total liability under and relating to this Agreement will not exceed the amount equal to the fees paid by the Business to Locallista during the month before the date of the occurrence of the damage (and if no fees were paid, then $1000 Euro).
6.18 Entire Agreement and reliance
These Terms, together with any policies and Category Commercial Terms referenced in them, form the entire agreement between Locallista and the Business regarding use of the Platform.
The Business confirms that it has not relied on statements, promises, or representations not set out in these Terms.
7. Legal and administrative
7.1 Governing law and jurisdiction
These Terms are governed by Portuguese law.
We do not expect disputes to reach court, and our first step will be to try to resolve things through good-faith discussions.
If you are a Business and we are unable to resolve our dispute after 30 days of good-faith discussions, you agree that the courts of Lisbon, Portugal have jurisdiction, unless mandatory law requires otherwise. Nothing in these Terms limit local mandatory rights you may have.
If you are a Customer, you may resort to the following Alternative Dispute Resolution entity in the event of a consumer dispute: Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL) (https://www.centroarbitragemlisboa.pt). Locallista does not adhere to arbitration or mediation unless required by applicable law. In addition, you may also have mandatory consumer protection rights under the laws of your country of residence. Nothing in these Terms limit those mandatory rights.
7.2 Complaints
We always do our best, but we realize that things sometimes go wrong. If you have a complaint, please contact us at legal@locallista.com.
Complaints Book. In accordance with Portuguese law, Locallista makes available the Electronic Complaints Book (Livro de Reclamações Eletrónico), accessible through the official platform at https://www.livroreclamacoes.pt. Complaints submitted through this platform are automatically forwarded to the competent regulatory authority, and Locallista will respond within 15 working days, as required by law.

7.3 Validity, waiver and set off
If any provision of these Terms is unenforceable, the remainder remains valid.
If you or Locallista do not enforce a provision of these Terms in a particular case, this does not mean it cannot be enforced in other cases. Except as expressly stated in these Terms, taking one action under these Terms does not prevent you or Locallista from taking other actions permitted by these Terms or by law.
All amounts owed under this agreement must be paid in full, without deduction or withholding by either party.
7.4 Rights to transfer
Only you and we have any rights under these Terms.
These Terms are personal to you and you cannot transfer any rights or obligations under them to anyone else without our written consent.
We will only transfer any of your and our rights and obligations under the Terms if we reasonably think that this won’t have a significant negative effect on your rights under these Terms (for example to one of our affiliates or as part of a merger or acquisition) or we need to do so to keep to any legal or regulatory requirement. When we transfer rights and obligations we call this “novation”. When we only transfer rights, we call this “assignment”.
7.5 Third party services
The Platform may use certain features of, or include links to, third-party websites or services that are governed by their own terms and privacy practices. Locallista does not control or endorse these third-party services and is not responsible for them. Use of these services is subject to the applicable terms and policies of the relevant third-party provider.
